Legal Regulations

  1. When processing personal data on our portal, we always proceed in accordance with the following legal regulations:
    • GDPR Regulation - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as "GDPR").
    • Regulation and Act No. 18/2018 Coll. on Personal Data Protection and on amending and supplementing certain acts (hereinafter also "Act").
  2. Due to the scope and subject of its activities, the operator is not obliged to appoint a data protection officer within the meaning of § 44 of the Act. Personal Data and Purpose of Processing

  1. Purposes of personal data processing:
    • Sale of service, issuance of tax document, contacting the customer regarding the order, performance of the contract, exercising liability for defects and damage (arising from the performance of the contract).
  2. Scope of processed personal data:
    • Name, surname, residential address, billing information, e-mail address, IP address.
  3. Legal basis for personal data processing:
    1. Article 6 | 1 let. b) GDPR - processing of personal data in the specified scope is necessary for the performance of the purchase contract implemented through the website, to which the data subject is a party as a buyer, or to take steps at the request of the data subject prior to entering into a contract,
    2. Article 6 | 1 let. c) GDPR - processing of personal data in the specified scope is necessary under special regulations or an international treaty by which the Slovak Republic is bound. This mainly concerns:
      • Act No. 102/2014 Coll. on the protection of consumers in respect of the sale of goods or provision of services under a distance contract or a contract negotiated away from business premises and on amending and supplementing certain acts,
      • Act No. 250/2007 Coll. on Consumer Protection and on Amendment to Act of the Slovak National Council No. 372/1990 Coll. on Offenses as amended,
      • Act No. 40/1964 Coll. Civil Code as amended,
      • Act No. 431/2002 Coll. on Accounting,
      • Act No. 222/2004 Coll. on Value Added Tax.
    3. Article 6 | 1 let. f) GDPR - processing of personal data in the specified scope is necessary for the purposes of the legitimate interests of the operator, specifically for the enforcement of the operator's legal claims through the courts. rights to damages.
  4. Personal data retention period:
    • the operator keeps accounting documents for 10 years,
    • the operator keeps registration data for the duration of the existence of an active user account.
    If the data subject cancels their registration, their personal data in the database will be deleted. If the data subject purchased a digital product and registered on the website for this purpose, their data remain in the operator's database for the duration of the execution of the purchase contract.

Cookies

  1. We process cookies on the legal basis according to Art. 1 let. a) GDPR - the data subject has given consent to the processing of their personal data for one or more specific purposes.
  2. The data subject has the right to withdraw their consent to the processing of personal data for the purpose of filling out the contact form at any time, in writing to the address of the operator's registered office, or to the e-mail address [email protected]. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
  3. The operator's websites use cookies to ensure necessary functionality, as well as to make the operator's websites more attractive, to remember user settings and to collect statistical information about users.
  4. Payment Gateway
    • In connection with cookies, the operator also uses the PayPal service, which provides a payment gateway.
  5. Analytics
    • In connection with cookies, the operator also uses Google Analytics, Matomo and Best Minecraft Servers services, through which it analyzes user behavior in order to optimize the functionality of the website. The operator uses the Google Analytics service with the "IP anonymization" function activated.

Rights of the Data Subject

  1. You have the right to request information about what personal data we hold about you (free of charge once a year). If this data is incorrect or incomplete, you can request that we correct or remove this information.
  2. We cannot remove your data if legal regulations on data retention prevent us from doing so, for example, the Accounting Act or other justified reasons, such as outstanding debts.
  3. You have the right to withdraw your consent to the processing of personal data at any time (Art. 7 Para. 3 GDPR), the right to request access to your personal data (Art. 15 GDPR), the right to their rectification (Art. 16 GDPR) or erasure (Art. 17 GDPR), the right to restriction of processing (Article 18 GDPR), to object to processing (Article 21 GDPR), you have the right to portability of this data to another controller (Article 20 GDPR), as well as the right to lodge a complaint with the Office for Personal Data Protection if you believe that our company proceeds in violation of GDPR when processing personal data (Art. 77 GDPR).

Retention and Protection of Personal Data

  1. The website operator approaches the protection of personal data responsibly and seriously. It treats personal data as confidential in accordance with relevant data protection legislation and this document.
  2. The operator processes personal data either manually or using electronic systems. The operator has taken all necessary organizational, technical and administrative measures to ensure the accuracy and timeliness of personal data, as well as to protect personal data against unauthorized or unlawful processing and accidental loss, destruction or damage, and to ensure the highest possible level of personal data protection. This personal data protection document may change over time. All changes regarding this document will be published on the website and affected persons whose personal data it processes will be informed before any changes are made. If required by law, the operator shall request consent from the data subject before any change to this document.
